Welcome to Kassan Super Markt, operated by Kassan UG haftungsbeschränkt, Wiesbaden, Germany. By placing an order on our website, you accept these Terms & Conditions, which are based on German and EU e-commerce law. Please read them carefully.

2. Scope of these Terms

These Terms apply to all orders placed via our online shop Kassan Super Markt by consumers (private individuals) and entrepreneurs (B2B). Differing terms of the customer are not recognized unless expressly agreed in writing.

3. Contract Formation

• By placing an order, you make a binding offer to purchase goods. The contract is concluded when we accept your order via explicit confirmation (email or order status update).
• Orders are subject to stock availability. We reserve the right to refuse or cancel orders in cases of error, non-payment, or suspected fraud.
• All product images and descriptions are for illustrative purposes; slight variations may occur (e.g., packaging design updates).

4. Prices & Payment Terms

• All prices are in euros (€) and include German VAT unless otherwise stated.
• Shipping costs are shown at checkout. Free shipping for orders over 100 €; under 100 € a flat 7,99 € fee applies (see Shipping section).
• Payment is due at the time of order. Accepted methods: Visa, Mastercard, Maestro, PayPal, SEPA bank transfer, Apple Pay.
• Orders are only processed after receipt of payment (bank transfer may take 1–2 days).
• Invoices will be provided electronically; printed copies available on request.

5. Shipping, Delivery & Risk

• Orders are processed within 24h (Mon–Fri) after payment, subject to stock availability. Delays during public holidays or high-volume periods may occur.
• Delivery within Germany: 2–3 working days. Other EU/EEA countries: 3–4 working days. Carriers: DPD, DHL.
• Risk passes to the customer upon delivery or receipt by an authorized third party.
• Frozen/chilled items: shipped Mon–Thu with insulated packaging. Kassan is not liable for spoiled frozen items if the customer is not present at delivery.
• Partial shipments may occur for large/bulk orders.
• Incorrect address, absence, or refusal of parcel may result in return fees or forfeited goods (no refund for perishables).

6. Retention of Title

Goods remain the property of Kassan UG haftungsbeschränkt until full payment is received.

7. Returns, Cancellations & Refunds

• Perishable goods (food, beverages, frozen): No right of withdrawal or return after dispatch, as per §312g BGB and EU law. Non-refundable for food safety reasons.
• Non-perishable/non-food items: 14-day right of withdrawal under EU law; must be unopened and unused. Return shipping at customer’s expense unless item is faulty.
• Damaged, incomplete, or wrong items: Report within 24 hours of delivery (with photos); we will arrange replacement or refund for the affected items.
• Order cancellation: Possible within 1 hour of placing order (before dispatch/processing starts). After that, no cancellation possible.
• Refund method: Same as original payment, after inspection/approval. No cash refunds.

8. Liability

• Kassan is liable only for damages caused by intent or gross negligence. Liability for slight negligence is excluded except for injury to life, body, health, or breach of essential contractual obligations (cardinal duties).
• In cases of breach of cardinal obligations, liability is limited to foreseeable damage typical for the contract.
• No liability for force majeure (e.g., strikes, natural disasters, pandemic-related delays).
• No liability for third-party sites, links, or services referenced on our website.

9. Data Protection

Personal data is processed in accordance with our Privacy Policy and applicable GDPR and BDSG rules.

10. Product Information & Allergen Notice

• All ingredients, allergens, and storage info are displayed on product labels and website. Responsibility for checking allergen info lies with the customer.
• Product images are illustrative. Packaging and appearance may differ slightly due to updates from manufacturers.
• All products are sourced from certified suppliers and comply with EU food safety laws.

11. Governing Law & Jurisdiction

• Contracts are governed by the laws of the Federal Republic of Germany, excluding UN sales law.
• For business customers, Wiesbaden is the exclusive place of jurisdiction.
• Consumer protection law of your EU country may apply in certain cases.
• Contract languages: English and German. In case of dispute, the German version prevails.

12. Dispute Resolution

• The EU Commission offers an online platform for dispute resolution (ODR platform). Kassan is not obliged and does not agree to participate in dispute resolution before a consumer arbitration board.

13. Final Provisions

• If any clause of these Terms is found invalid, the remainder remains in effect. Invalid clauses are replaced by legally valid ones closest in meaning and intent.
• We reserve the right to update these Terms at any time; changes will be published on this page with the latest revision date.
